The Subclass-189 Skilled Independent Visa and the Subclass-190 Skilled Nominated Visa are both permanent resident visas that allow foreign workers and their families to live and work in Australia for an unlimited length of time and include other benefits. TheSubclass-491 Skilled Work Regional (Provisional) Visa is a temporary Australian work visa that is valid for five years and allows the foreign worker’s family to also live in Australia. The GSM Subclass-491 Skilled Regional (Provisional) Visa is a temporary work visa to Australia which is granted for five years to a skilled migrant who has been nominated by an Australian State or Territory governmental agency, or who has been sponsored by an eligible family member who is living in Australia, and who also satisfies the other eligibility criteria for this GSM visa subclass. Although this is a temporary work visa to Australia, which is valid for five years from the date it is issued and it cannot be renewed, the Subclass-491 Skilled Regional (Provisional) Visa does have a pathway to Australian permanent residency for those who qualify for the Subclass-191 Permanent Residence (Skilled Regional) Visa which launches on November 16, 2022.The Subclass-491 Skilled Regional (Provisional) Visa permits a skilled foreign worker and his/her eligible family members to live, work and study in a Regional Designated Area of Australia (examples include Adelaide, Canberra, Geelong, Gold Coast, Hobart, Newcastle, Sunshine Coast, Perth, and Wollongong), and allows them to travel to and from Australia, during the five years that their Australian visa is valid.

All three General Skilled Migration (GSM) visa subclasses (i.e., subclasses 189, 190 and 491) allow skilled foreign workers to bring their eligible family members to live in Australia with them.Eligible family members can include a spouse or partner (opposite sex or same sex) and “dependent” children. For the purposes of immigration to Australia through the GSM program, a “dependent child” is usually defined as your or your partner’s child who is under 18 years of age and is not married, engaged to be married nor in a de facto partnership, and is completely or significantly dependent on you for his/her basic needs of food, shelterand clothing. In some cases, however, your or your partner’s adult child who is over 18 years of age may be able to qualify as a “dependent child” for the purposes of Australian immigration through the GSM program (for example, if he/she depends on you more than anyone else to provide completely or significantly their basic needs of food, shelter and clothing). Family members must satisfy the good character and good healthrequirements and other criteria as relevant in order to receive a visa to Australia.
A foreign worker who wants to immigrate to Australia through the General Skilled Migration (GSM) program must have an occupation that is on the Skilled Occupation List for the relevant GSM subclass (i.e., subclass 189, 190 or 491), and he/she needs to receive a suitable Skills Assessment from the relevant Australian assessing authority for that occupation. The Skills Assessment evaluates whether a foreign worker has the job skills that are necessary for a particular occupation in Australia. The results of the Skills Assessment will be required when the foreign worker files his/her Expression of Interest (EOI).
Skilled foreign workers applying for an Australian visa through the General Skilled Migration (GSM) program must demonstrate at least “Competent” English language abilities to satisfy the English language requirement. In order to receive points for English (i.e., counting toward the minimum score of 65 points required for the GSM program), however, foreign workers will need to show that they have “Proficient” or “Superior” English language skills. For the purposes of Australian immigration through the GSM program, “Competent” English language abilities can be demonstrated by: (1) holding a valid passport as a citizen of Canada, Ireland, New Zealand, the United Kingdom or the United States; or (2) getting the required score on the International English Language Testing System (IELTS) exam, or the Test of English as a Foreign Language internet-based Test (TOEFL iBT), or the Pearson Test of English Academic (PTE Academic), or the Occupational English Test (OET), or the Cambridge C1 Advanced test. The English evaluation test results must have been received three years or less prior to the date of the Invitation to Apply (ITA).Citizens of Canada, Ireland, New Zealand, the United Kingdom and the United States may want to take one of the English language exams listed above so they could potentially receive points if they are assessed with “Proficient” or “Superior” English language skills, since zero points are given for the minimum standard of “Competent” English.
The Expression of Interest (EOI) is filed online by a skilled foreign worker who wants to immigrate to Australia through the General Skilled Migration (GSM) program. The EOI contains details about the foreign worker (e.g., education, work experience, Skills Assessment, English level, etc.) and his/her family which will be reviewed by the Australian immigration officials and used to help them decide whether to issue an Invitation to Apply (ITA) for the relevant Australian visa.
After a skilled foreign worker files an online Expression of Interest (EOI) to immigrate to Australia, the information in the EOI is reviewed by the Australian immigration authorities, and if they determine that the foreign worker appears to satisfy the eligibility requirements for the GSM program, they may issue an Invitation to Apply (ITA) for the relevant GSM visa to Australia. A foreign worker who receives an ITA will have up to 60 days to file the Australian Visa Application, which will include all of the supporting documents and the visa application fee.
The skilled foreign worker must be under 45 years of age when he/she receives the Invitation to Apply (ITA) for an Australian visa through the General Skilled Migration (GSM) program.
The amount of time required to complete the Australian immigration procedure through the GSM program depends on different factors, such as the foreign worker’s occupation, the specific GSM visa subclass, how long it takes him/her to get a suitable Skills Assessment and English evaluation score, as well as how fast he/she can prepare and send the Australian visa application with all of the supporting documents. In general, the processing time for a complete Australian GSM visa application is about 8-12 months.
